Terms of Use

Welcome to Oshn Meditation! These Terms of Use govern your use of the Oshn Meditation mobile application and related services provided by Ilia Ilinskii PR Novi Sad.

1. Acceptance of Terms

By accessing or using Oshn Meditation, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Service.

Age Requirement: You must be at least 13 years old to use our Service. Users between the ages of 13 and 17 must have the consent of a parent or legal guardian to use the Service.

2. Description of Service

Oshn Meditation is an AI-powered meditation application that:

  • Generates personalized meditation scripts based on how you feel

  • Provides AI-synthesized audio voice-overs for meditation sessions

  • Offers an AI chat companion (Oshn) for daily reflection and mood check-ins

  • Tracks your meditation progress, streaks, and mood trends

  • Offers a library of ready-made meditations, background music, and sounds

  • Optionally connects to Apple Health to personalize your practice and save your mindful minutes

Important: Our Service is intended for wellness and relaxation purposes only. It is not intended to diagnose, treat, or prevent any disease and is not a substitute for professional medical advice.

3. Subscriptions and Billing

Parts of the Service require a paid subscription (Oshn Premium), offered as auto-renewable monthly or yearly plans purchased through Apple's App Store:

  • Payment is charged to your Apple Account at confirmation of purchase

  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; the renewal price is charged within 24 hours before the period ends

  • If a free trial is offered, the trial converts into a paid subscription at the end of the trial period unless you cancel at least 24 hours before it ends; any unused portion of a free trial is forfeited when you purchase a subscription

  • You can manage or cancel your subscription at any time in your Apple Account settings (App Store → your profile → Subscriptions, or apps.apple.com/account/subscriptions); deleting the app or your Oshn account does not cancel a subscription

  • Prices are shown in the app before purchase and may vary by region; if prices change, the change applies from your next billing period and Apple will notify you as required

  • Payments, refunds, and billing disputes are handled by Apple under Apple's Media Services Terms; to request a refund, visit reportaproblem.apple.com

4. User Accounts and Registration

4.1 Account Creation

  • You must provide accurate and complete information when creating an account

  • You are responsible for maintaining the confidentiality of your account credentials

  • You must notify us immediately of any unauthorized use of your account

  • An individual may not have more than one account

4.2 Account Responsibility

  • You are responsible for all activities that occur under your account

  • You must maintain up-to-date contact information

  • You may not transfer your account to another person without our consent

  • You may delete your account at any time in the app (Settings → Security → Delete Account)

5. Acceptable Use

5.1 Permitted Use

You may use our Service for personal, non-commercial meditation and wellness purposes in accordance with these Terms.

5.2 Prohibited Use

You agree NOT to use the Service to:

  • Transmit inappropriate, harmful, or offensive content, including attempts to make the AI produce such content

  • Attempt to gain unauthorized access to our systems

  • Use automated scripts, bots, or other tools

  • Reverse-engineer or attempt to extract the source code, models, or prompts

  • Use the Service for commercial purposes without our written consent

  • Bypass security, rate limits, or access control measures

6. AI-Generated Content and AI Assistant

6.1 You Are Interacting With AI

  • Meditation scripts and narration are generated by artificial intelligence; the voice you hear is synthetic, AI-generated speech, not a human recording

  • The Oshn chat companion is an AI system, not a human. It does not provide medical or psychological advice, therapy, or crisis support

  • AI-generated responses and content may be inaccurate, incomplete, or not suited to your situation. Use your own judgment, and do not rely on the Service for decisions about your health

6.2 Content Rights

  • You retain the rights to your personal data and the inputs you provide

  • We retain all rights to the AI models, prompts, algorithms, and underlying technology

  • Generated meditation content is licensed to you for personal, non-commercial use only

  • You may not redistribute or commercialize generated content without our written permission

7. Apple Health Integration

  • Connecting Apple Health is optional. You choose exactly which data categories to grant in the iOS permission dialogs, and you can change or revoke access at any time in iOS Settings or the Health app

  • With your permission, the app reads activity and sleep data to personalize your meditations, and saves your completed sessions as Mindful Minutes and your check-ins as State of Mind entries in Apple Health

  • Health data is handled under the strict limits described in our Privacy Policy: it is never used for advertising or marketing, never sold, and is kept on our servers for a maximum of 30 days

  • Health-based personalization is a wellness feature, not a medical assessment. Values you see are based on data provided by Apple Health and may be incomplete or inaccurate

8. Health and Medical Disclaimer

Medical Disclaimer: Oshn Meditation is not a medical device, healthcare service, or mental health treatment. We are not a licensed medical provider, and the Service does not create a doctor–patient relationship. Our Service provides general wellness content and should not replace professional medical advice, diagnosis, or treatment.

8.1 Not Medical Advice

  • The content provided is for informational and wellness purposes only

  • Always consult with qualified healthcare professionals for medical concerns, and before using meditation as part of a treatment plan

  • If you have an existing mental health condition, talk to your care provider before relying on the Service

  • We make no guarantees about health outcomes or therapeutic effects

8.2 Emergencies

  • The Service is not designed for crisis situations and cannot call for help

  • If you are experiencing a medical or mental health emergency, or having thoughts of suicide or self-harm, contact your local emergency number immediately (for example, 112 in the EU, 911 in the US) or a local crisis line (for example, 988 in the US)

8.3 Individual Responsibility

  • You are responsible for your own health and wellness decisions

  • Discontinue use of the Service if you experience any adverse effects

9. Privacy and Data

Your privacy is important to us. The collection, use, and protection of your information are governed by our Privacy Policy, which is incorporated into these Terms. In short:

  • Your emotional inputs, mood check-ins, and chat messages are used to generate and personalize meditations

  • Some inputs are processed by third-party AI providers (OpenAI, ElevenLabs) acting on our behalf, as described in the Privacy Policy

  • Apple Health data is used only with your explicit permission, only for personalization and your own progress, and never for advertising

  • You can delete your account and data in the app at any time

10. Intellectual Property

The Service, including its design, branding, software, meditation library, music, and all content we created, is owned by us or our licensors and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal purposes on Apple devices that you own or control, subject to Apple's Media Services Terms.

11. Termination

  • You may stop using the Service and delete your account at any time

  • We may suspend or terminate your access if you materially violate these Terms, abuse the Service, or where required by law; where practicable, we will notify you

  • Upon termination, your license to use the Service ends; provisions that by their nature should survive (including disclaimers, limitations of liability, and IP provisions) survive termination

12. Disclaimers and Limitation of Liability

  • The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted availability

  • To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages, or loss of data, arising from your use of the Service; our total liability is limited to the amount you paid us in the 12 months before the claim

  • Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including your statutory rights as a consumer in your country of residence (for example, in the EU/EEA and UK). Nothing in these Terms affects mandatory consumer protections of the country where you live

13. Governing Law and Changes

  • These Terms are governed by the laws of the Republic of Serbia, without prejudice to mandatory consumer protection rules of your country of residence; consumers may also bring claims before their local courts where the law provides for it

  • We may update these Terms from time to time. We will post the updated version with a new "Last Updated" date and, for material changes, notify you in the app. Continued use after changes take effect constitutes acceptance
